1. Introduction

These Terms & Conditions (“Terms”) govern your access to and use of the iCare Connect Services platform, including our website, mobile applications, and related services (“Services”).

By accessing or using the Services, you agree to be bound by these Terms.

If you do not agree, you must not use the Services.

iCare Connect Services Ltd (“we”, “us”, “our”) provides a technology platform that connects individuals seeking unregulated care services (“Care Receivers”) with independent third-party care providers (“Carers”).

We do not provide care, supervise care, or employ Carers.


2. Definitions

• “Carer” – an independent third-party provider offering unregulated care services through the platform.
• “Care Receiver” – an individual receiving care services.
• “User” – any person using the Services, including Carers and Care Receivers.
• “Booking” – a confirmed arrangement for care services between a User and a Carer.
• “Platform” – the iCare Connect Services website, app, and related systems.


3. Marketplace-Only Role

iCare Connect Services is not a care provider.

We do not:

• Employ Carers
• Supervise care delivery
• Provide regulated care
• Create or review care plans
• Guarantee suitability or safety
• Accept liability for care outcomes

All care services are provided by independent Carers, who operate as self-employed contractors.


4. User Accounts

To use most features, you must create an account and provide:

• Full name
• Address
• Date of birth
• Mobile number
• Email address
• Valid payment method

You must keep your information accurate and up to date.

You may only have one account unless we approve otherwise.

You are responsible for all activity under your account.


5. Carer Verification (DBS & ID)

All Carers must:

• Upload a valid DBS certificate (Basic, Standard, or Enhanced)
• Provide valid photo ID (passport or driving licence)
• Confirm their right to work in the UK

We may conduct ID verification checks, but:

• We do not guarantee the authenticity of documents
• We do not guarantee DBS status
• We do not monitor changes in criminal records

Care Receivers must conduct their own due diligence.


6. User Responsibilities

Users must:

• Act lawfully and respectfully
• Provide accurate information
• Use the Services only for lawful purposes
• Not misuse or attempt to hack the platform
• Not attempt to take bookings off-platform
• Not share account access

Care Receivers must:

• Assess the suitability of Carers
• Verify DBS and ID documents
• Ensure a safe environment for care
• Supervise vulnerable individuals where appropriate

Carers must follow the Carer Code of Conduct.


7. Safeguarding

We take safeguarding seriously, but we are not a regulated care provider.

Users are responsible for:

• Assessing suitability
• Verifying documents
• Supervising care where needed
• Reporting safeguarding concerns

If you suspect abuse, neglect, or risk of harm, you must:

  1. Stop using the Carer immediately.
  2. Contact the appropriate authority (e.g., Local Authority Safeguarding Team or police).
  3. Notify us at safeguarding@icareconnectservices.com.

8. Payments

Payments for care services are processed through the platform.

We act as the limited payment collection agent for Carers.

• Charges are due immediately
• Payments are final and non-refundable unless we decide otherwise
• Prices may vary based on demand
• Cancellation fees may apply
• Tips are voluntary

If your payment method fails, we may charge a backup method.


9. Cancellations

Care Receivers may cancel a booking before the Carer arrives, but a cancellation fee may apply.

Carers who repeatedly cancel may be removed from the platform.


10. User-Provided Content

You may upload content (reviews, messages, documents).

You retain ownership but grant us a worldwide, royalty-free licence to use, display, and distribute such content.

You must not upload:

• Offensive, illegal, or harmful content
• False or misleading information
• Content infringing third-party rights

We may remove content at our discretion.


11. Platform Access & Technology

You are responsible for:

• Your device
• Your internet connection
• Data charges

We do not guarantee:

• Uninterrupted access
• Error-free operation
• Compatibility with all devices


12. Disclaimers

The Services are provided “as is” and “as available”.

We do not guarantee:

• The quality, safety, or suitability of Carers
• The accuracy of user-provided information
• The reliability or timeliness of care services
• Uninterrupted platform access

You use the Services at your own risk.


13. Limitation of Liability

To the fullest extent permitted by law:

• We are not liable for the actions or omissions of Carers
• We are not liable for injury, loss, damage, or misconduct arising from care services
• We are not liable for indirect or consequential losses

Our total liability to you shall not exceed £500.

Nothing in these Terms limits your statutory rights.


14. Indemnity

You agree to indemnify and hold harmless iCare Connect Services from claims arising from:

• Your use of the Services
• Your breach of these Terms
• Your interactions with Carers
• Your uploaded content


15. Governing Law & Dispute Resolution

These Terms are governed by the laws of England and Wales.

15.1 Informal Resolution

15.2 Mediation (Optional)

Either party may request mediation through a UK-recognised provider (e.g., CEDR).

15.3 Arbitration (If Both Parties Agree)

If both parties consent, disputes may be resolved by binding arbitration under the Arbitration Act 1996.

15.4 Court Jurisdiction

If mediation/arbitration is not used, disputes shall be resolved exclusively in the courts of England and Wales.


16. Law Enforcement Requests

We may disclose user information when required by law, including:

• Court orders
• Warrants
• Lawful data disclosure requests

We will notify users unless prohibited by law.


17. Assignment

You may not transfer your rights under these Terms.

We may assign these Terms to:

• Affiliates
• Successors
• Purchasers of our business


18. Termination

We may suspend or terminate your account if:

• You breach these Terms
• Safeguarding concerns arise
• Fraudulent activity is suspected
• You misuse the platform

You may close your account at any time.


19. Intellectual Property

All platform content, branding, and technology belong to iCare Connect Services or its licensors.

You may not:

• Copy
• Modify
• Distribute
• Reverse engineer

any part of the Services.


20. Entire Agreement

These Terms constitute the entire agreement between you and iCare Connect Services.
